Legal advice is the opinion given by counsel to a client to the best of their ability, whether it affects the client favourably or unfavourbly. Everyone is entitled to legal representation, and in civil matters you must pass a means test, which is based on income, to qualify for assistance; aid is available only to the lowest income groups.
- You can ask an attorney for legal advice, and for those who can't afford an attorney, help is still available as you can contact the Legal Aid Board at the nearest Justice Centre.
- You can also contact your nearest family- or maintenance court at the magistrate's court for advice. Failing that, you can seek further advice at the Court Manager of the specific magistrate's court or High Court.
Unfair dismissal:
If an employee is dismissed, reasons for such dismissal must be given, and the employee has the right to appeal, and has the right to take the matter to the CCMA. A dismissal will only be justified if the misconduct committed by the employee is so serious that it makes the continuation of the employment intolerable. If the employee alleges that his resignation was not tendered voluntarily, but was in fact the result of the employer having made his working environment intolerable, legal advice will have to be sought.
