:: Anton Rudman ATTORNEYS :PROPERTY ATTORNEY
Buying a piece of land is the first step in what will almost certainly be the biggest investment of your life. To buy successfully you will need a realistic assessment of what you can afford, and methodical planning. Commercial property consists primarily of office space, retail property and factories. Choose your area with care. If it's residential, is it convenient to your place of work? The piece of ground itself too, will need careful consideration: size and ground conditions are factors that will affect not only the cost and quality of your future home or business, but its value on the property market. Anton Rudman Attorneys own their own development company and are well acquainted with the purchase and transfer of commercial property.
Once you have decided to buy the property, whether with the assistance of an estate agent or not, the parties are required to conclude a written agreement, setting out the terms and conditions of the specific property. A property attorney must assist with the conveyancing, which is the legal procedure whereby ownership of immovable property is changed.
Property attorneys should have completed a special qualifying examination in property law. Because property is such a complicated branch of law, the attorneys are required to understand a multitude of parliamentary Acts, regulations and high court decisions relating to property. The seller appoints the property attorney to handle the transfer of the property into the name of the purchaser. If the buyer does not comply with the contract, not only the seller loses the proceeds of the sale, but the attorney loses out on the conveyancing fees payable.
Property attorneys also:
- assist developers in tying up the land
- work with town-planners on the rezoning of the land
- draft and finalise agreements of sale for the end purchasers of units in a development
- pass transfer of the units to the end purchasers
- assist you in concluding the contract of sale and understanding the legalities involved in taking transfer
