Just as the Constitution has reshaped South Africa, the Annual Labour Law will reshape the workplace, and keeping abreast of important developments in the changing field of labour law is a constant challenge. The old structures for the determination of disputes, some of the technical procedures as well as some of the clauses that prevented industrial fairness and justice from reaching many employees in the economy are all gone and the new Annual Labour Law has brought needed change.

This year at the Annual Labour Law Conference, the theme of the conference was Transformation: Expectations and Constraint where they claimed that whilst progress has been recorded in a number of areas, there were still areas that needed to be intensified:

• Gender discrimination: in a continuing effort to consolidate this process of transformation, a process of developing a Decent Work Country Programme has been introduced where all sorts of discrimination will be addressed, and women and youth, as part of the historically marginalised , will be accorded the necessary attention.
• While written contracts of employment showed an improvement in compliance, there is still evidence that a large percentage of workers still do not have a written contract of employment detailing their wage rate, leave provisions, hours of work and other conditions of employment.
